The Members of the Authority have called a special Full Board Meeting for Friday, January 29, 2010 at 3:00pm. There is one matter up for consideration on the agenda.

PERMIT NOTICE - 12/30/2009
Effective immediately, all permits issued to a licensee will be mailed to the licensed premises. The authority will no longer allow either the licensee, their attorney, representative or a third party to pick up permits at state liquor authority offices.
Also, as stated in the application, all permit applications must be filed at least 15 business days prior to the date of an event. Applications filed with less than 15 business days notice will be disapproved.
Any person found to be filing a fraudulent application will be prosecuted to the fullest extent of the law.
SLA TO GRANT RECONSIDERATION ON NEW YEAR’S PERMITS - 12/01/2009
Applications Will Be Accepted Up To December 7th.
The New York State Liquor Authority (SLA) will grant reconsideration to licensees who filed for “All Night Permits” after the November 17, 2009 deadline. Reconsideration will be granted if the application is received by December 7th and only if the application was disapproved for late filing.
Disapprovals for late filing and cause must go to a Member of the Authority for reconsideration.

SELF CERTIFICATION PROGRAM - September 11, 2009
The Members of the Authority have approved the implementation of the Self Certification Program. This program allows attorneys filing retail applications on behalf of applicants to certify that statements and documents provided in an application are true and accurate and that the application meets all statutory requirements. The program will allow for a more timely review of applications as the agency will rely on the information certified by the Attorney, eliminating the need to review each document submitted.

RESOLUTION TO EXPEDITE FULL BOARD CASES
As part of an overall strategy by newly appointed SLA Chairman Dennis Rosen to shorten the license application process time, the Members of the State Liquor Authority voted on September 30, 2009 to delegate power to individual Members to accept Conditional No Contest pleas (offers to settle cases without holding a hearing) for certain routine disciplinary matters. In addition to accepting the Conditional No Contest Plea, an individual Member of the Authority may also impose a penalty less than that offered, or submit the matter to the Full Board. The individual Members will be conducting these reviews on a rotating basis, which will not only reduce the amount of time licensees wait for a decision, but will also lead to a reduction in the number of cases pending before the Authority.

NEW ON-PREMISES LICENSE CERTIFICATES
In our continuing effort to provide more information to local governments, local law enforcement and the public, the State Liquor Authority will begin issuing multi-colored license certificates indicating the type of establishment licensed. The license certificates will be color coded depending on the type of establishment: Mixed Use (Purple), Nightclub/Cabaret (Red), Restaurant Wine (Olive), Other (Blue). The new licenses will also list details of the Method of Operation of the licensed premises including: days and hours of operation, whether live music or dancing is permitted, if the premises includes an outside area, etc.

SLA ANNOUNCES SIMPLIFIED LICENSING APPLICATION(S) FOR OFF-PREMISES ESTABLISHMENTS
In our continuing effort to simplify and expedite the licensing process, the SLA is introducing new applications for Off-Premises applicants (grocery stores, drug stores, liquor stores and wine stores). The Licensing Bureau has modified the application by removing all sections not relating directly to Off-Premises applicants. The new applications are directed at improving efficiency by providing an easier licensing process for applicants. Applicants can shorten the timeframe it takes for a decision by reading the instructions thoroughly and submitting a complete application. By utilizing our examiners time on reviewing completed applications, the State Liquor Authority will be able to act on license applications in the most expeditious manner possible. After you have completed the application, use the Filing Checklist to ensure that you have met all filing requirements. Failure to submit any of the required documents may result in the rejection of your application or in processing delays.
